Fair Presentation of Risk


Before you enter into an insurance contract, and before you renew, extend, vary or reinstate a contract, you are required to make a fair presentation of the risk to the insurer.


A fair presentation of the risk requires you to:

  • disclose every material circumstance which you know or ought to know following a reasonable search of information available to you;
  • ensure that every representation of fact or expectation is substantially correct and not misleading; and
  • present information in a manner that is reasonably clear and accessible to the insurer.

 

Material circumstances are those that would influence the judgement of a prudent insurer in deciding whether to accept the risk, on what terms, and at what premium.

 

You are responsible for ensuring that all information provided to us and to our insurance capacity providers is accurate, complete and not misleading. Failure to make a fair presentation of the risk may affect whether cover is available, the terms on which it is offered, or whether a claim is accepted or paid.


Scope of Advice


Yeltrah Ltd does not recommend an insurance policy for you or provide any regulated financial advice within the meaning of the Financial Markets Conduct Act 2013. We can only provide factual and general information on the contingency products provided by Certain Underwriters at Lloyd's and other insurers. Yeltrah Ltd trading as EventCover does not act as your agent, nor as an insurance broker or insurance adviser. The information provided has been prepared without considering your personal circumstances, financial situation or needs. Before acting on any information provided, you should consider its appropriateness to your circumstances. If the information relates to the acquisition of an insurance policy, you should read the policy documents and determine whether to obtain financial advice before making any decision.


Renewing the Policy


We will send you notification of whether we are prepared to negotiate to renew the policy and, if so, on what terms, at least 14 days before the expiry date of your policy.

 

Unless we require a new proposal or declaration from you (we will tell you by email if this is the case), the renewal notice will show the premium for the new period of insurance and may include notice of any changes to the terms of your policy.

 

When you receive a renewal offer, you must tell us before expiry if any information contained in it is incorrect or incomplete, and make any additional disclosure required. We will then consider that information and determine whether we can offer renewal terms and on what basis.

 

If we are not able to automatically renew your policy, we will send you an email notification for you to complete your renewal online or to contact us. Please ensure you keep us updated of any change to your email address.


Commission and Fees


COMMISSION

We receive a commission calculated as a percentage of the premium. The commission is paid at a rate between 0% and 27.7%. From that, retail brokers may receive a commission capped at a maximum of 25% of base premium, and reinsurance brokers may receive 5%. Our net commission supports product research and development, underwriting, marketing, design and maintenance of our IT transaction platform and websites, staff training and development, broker education and general administrative and overhead expenses. Commission is included in the total amount you pay and is not in addition to the insurance policy.

 

The commission applies to each policy issued or renewed through us. Commission may not be refundable on cancellation unless the policy is cancelled within the cooling-off period or is a full term cancellation.



PROFIT COMMISSION
EventCover has the potential to earn a profit share commission based upon performance of the book of business. Due to the contingent nature of insurance and the way the arrangement is structured, it is not possible to know the exact amount, if any, to which we may be entitled until the end of the qualifying period.


POLICY FEES
In some circumstances, we may charge a Policy Fee.  The Policy Fee, as applicable, is noted on your insurance schedule and tax invoice. This fee charged by EventCover is calculated as 15% of your base premium, capped at NZD $150 excluding GST.  Such fees include meeting our costs of preparation and distribution of documentation.  

The Policy Fee applies to each policy issued or renewed through us.

The Policy Fee is not refundable in the event of cancellation unless the insurance policy is cancelled either within the cooling-off period or is a full term cancellation.


CANCELLATION FEES
We do not charge a fee for cancellation of the insurance policy.
You may cancel your insurance policy in line with the terms and conditions of the policy.  If you choose to cancel your insurance policy and a refund is available, we will retain a portion of the premium that relates to the period for which you have been insured.  We may refund the residual for the unexpired period less any non-refundable taxes, charges and levies provided that no event has occurred where liability arises under the insurance policy.


Remuneration Rights on Policy Cancellation


On cancellation of any insurance policy effected through Yeltrah Ltd, unless the cancellation takes place within any applicable cooling off period, you agree that the commission and any fees paid to Yeltrah are non refundable to you and may be deducted by Yeltrah from any refund otherwise payable by the insurer to you on cancellation of the policy, irrespective of any terms to the contrary in the policy.


Privacy Notice


In this Privacy Notice, "we", "our" and "us" means Yeltrah Ltd trading as EventCover, its representatives, related companies, and third parties who provide services to us or on our behalf.

 

We collect, hold, use and disclose personal information in accordance with the New Zealand Privacy Act 2020 and, where applicable, the Australian Privacy Act 1988 (Cth). Our Privacy Policy explains what personal information we collect, how we collect it and from whom, how we hold, use and disclose it, and how you can access, correct or make a complaint about our handling of it.

 

We do not sell, publish or give away your personal information.

 

We will use your personal information for the purposes for which it was collected, which includes arranging insurance, administering policies, assisting with claims, and communicating with you, as further described in our Privacy Policy. We may also be required to disclose personal information to law enforcement, government agencies or regulatory bodies where required by law.

 

You have the right to access and correct your personal information held by us, subject to the provisions of the Privacy Act 2020. If you choose not to provide personal information we request, we or our insurance capacity providers may be unable to provide you with a quote, arrange or issue insurance, administer a policy, communicate with you, or respond to your enquiries.

The content of this site and any contracts formed with Yeltrah Limited arising out of this site are governed by New Zealand law and the non-exclusive jurisdiction of the New Zealand Courts.
